Terms, Conditions & Policies

Creative Culture Productions (Pty) Ltd Academic Year: 1 October – 30 September Jurisdiction: Republic of South Africa 1. THE DCS CODE & GOVERNANCE 1.1 The "Artistic Athlete" Standard At DCS, we facilitate elite performance. Every member—student, parent, or visitor—is bound by the principles of Kindness, Respect, and Discipline. Parents and dancers must maintain a professional and supportive attitude. Public dissent, "lobbying" in communal areas, or any behaviour that undermines the studio’s reputation or coaching authority is grounds for immediate termination of services. The Space: Dancers are stewards of the studio. No mirror touching, no food in the training area, and a strict "leave it better than you found it" policy applies to all venues (Home Base and Satellites). 2. TERMS & CONDITIONS OF SERVICE 2.1 Introduction & Governing Law Dance Culture Studios is operated by Creative Culture Productions (Pty) Ltd. By accessing our website, registering for classes, or entering our premises, you agree to be bound by these Terms, governed by the laws of South Africa. 2.2 The Academic Cycle & Membership The Year: Our academic and financial cycle runs from 1 October to 30 September. 12-Month Commitment: Enrolment in Tiers 2, 3, and 4 constitutes a binding 12-month agreement. Probationary Period: All new students must complete a 4-week Starter Introductory Package. Permanent membership is offered solely at the discretion of Management following an assessment of technical level and cultural fit. 2.3 Attendance & The Three-Class Rule DCS prioritises excellence. Any dancer who misses three or more classes in a single term may be disqualified from competitions, international tours, or showcases. Absences must be logged via the Wix Member App 24 hours in advance. 3. FINANCIAL POLICY & REFUND STATUTES 3.1 Registration & Tuition Registration Fee: A non-refundable R800 annual fee is payable by all members (excluding ad-hoc drop-ins). Payment Terms: Tuition is due on the 1st of each month. Late payments after the 3rd incur a 5% penalty. Private Coaching: Must be paid upfront. A 24-hour notice is required for cancellations, or the fee is forfeited. Rescheduling must occur within 30 days. 3.2 Refund Policy (7-Day Cooling Off) In accordance with South African Consumer Law, clients are entitled to a 7-day cooling-off period from the date of purchase or commencement of services (whichever is later). During this window, a full refund may be requested. 3.3 Cancellation (30-Day Notice) Beyond the cooling-off period, all service agreements require a one full calendar month’s written notice (30 days) sent to info@danceculture.co.za. Early Termination Levy: Breaking a 12-month agreement (Tiers 2–4) incurs a cancellation fee of 50% of the remaining contract value. 3.4 Return Policy (Services) As DCS provides professional services (training) and not physical goods, returns do not apply. Clients are liable to pay for any dance class attended, regardless of experience level. 4. INTELLECTUAL PROPERTY (IP) PROTECTION 4.1 Choreographic Ownership All choreography, training methodologies, and artistic concepts created at DCS are the exclusive IP of Creative Culture Productions (Pty) Ltd. Non-Compete/Non-Teaching: No member may use DCS choreography for external performances, talent shows, or private teaching without express written consent. Media Infringement: Posting full-length tutorials or "Behind-the-scenes" competition choreography online without permission is strictly prohibited. 5. PRIVACY POLICY & POPIA COMPLIANCE 5.1 Data Collection & Storage Your privacy is governed by the Protection of Personal Information Act (POPIA). Information Collected: We collect email addresses (opt-in basis), billing details (via third-party processors), and student performance data. Usage: Information is used solely for studio administration, safety, and communication. We do not share or disclose your data to third parties except for payment processing or legal requirements. Communication: By enrolling, you consent to receive communications via email and the Wix App. You may withdraw consent at any time via written notice. 5.2 Media Release DCS captures content for marketing and educational purposes. Members grant DCS an irrevocable right to use their likeness (photo/video) for studio promotions. Opt-outs must be submitted in writing during registration. 6. LIABILITY & MEDICAL CONSENT 6.1 Assumption of Risk Dance is a high-intensity physical activity. DCS, Creative Culture Productions (Pty) Ltd, and its staff accept no liability for injury, medical emergencies, or loss of property sustained on or off the premises. 6.2 Emergency Authority In a medical emergency where guardians are unreachable, DCS Management is authorised to seek medical care at the parent/member's expense. 7.
